Clive Hyer is a Commercial Litigator, Clive joined Rosenblatt in 1992 and became a partner in 1996. The majority of Clive's practice is the handling of contract and negligence disputes between individuals and companies. Over the past decade Clive has developed a specialist practice advising as to the enforcement of restrictive covenants (in employment contracts) and advising as to all aspects of employee team moves (whether for "the poacher" employer, "the gamekeeper" employer or the employees trying to move). Clive has extensive experience over 25 years of High Court litigation. He also undertakes occasional personal injury work for severely injured claimants.

Notable recent cases where Clive acted for the successful party include:

  • Tullett Prebon Group Ltd v G El-Hajjali (2007): A fixed and ascertained agreed damages clause was enforceable in an employment contract of an employee who refused to show for work and the clause was not a penalty.
  • Tullett Prebon Plc & Others v BGC Brokers LP & Others (2009): Employer entitled to interim injunction against a team of brokers who attempted to join a competitor in breach of contract.
  • Tullett Prebon Plc v BGC Brokers LP & Others (2010): Judgment that a rival broker firm had conspired unlawfully to seek to enable brokers at its competitor to leave early by contriving false constructive dismissal situations.
  • Isla Richmond v East & North Hertfordshire NHS Trust (2007): Obtaining (at the time) one of the largest awards of an interim payment for a baby severely injured by an NHS Trust.
