Private Prosecutions | Rosenblatt’s Financial Crime Team

On 5 March 2020 it was widely reported in several media outlets that a leaked Home Office report had concluded that cuts to police figures were a significant contribution to an increase in murders since 2014.

Many other crimes such as fraud, other financial crime and sexual offences have risen over the years. With cuts suffered by the police and Crown Prosecution Service they are not able to deal with the volume of reports that they are receiving and many serious cases are falling between the cracks.

Action Fraud was set up by the police to deal with financial crime, but they rarely respond to reports made to them and as exposed in a Times newspaper investigation, those employed are not adequately trained to deal with complex financial crime.

You can take control of the investigation and initiation of a private prosecution without the intervention of the Police and Crown Prosecution Service.

Every person has the right to bring a private prosecution for a criminal offence in accordance with section 6(1) of the Prosecution of Offences Act 1985.

Starting a Private Prosecution | Rosenblatt’s Financial Crime Team Explains

We conduct the investigation and gather all the evidence.  To start the case, we must present all the evidence to a Magistrates’ Court in order to persuade the Judge a crime has been committed and it should be prosecuted. Once the Judge is satisfied that evidentially there is sufficient evidence to prosecute and it is in the public interest a summons will be issued for the defendant to attend court.

The defendant will be summonsed to attend the Magistrates’ Court and enter a plea of guilty or not guilty.  The court will consider the defendant’s bail position and if serious enough the case will be sent to a Crown Court to proceed to trial.
